Potential Canada Post service interruption

This is a reminder to Licensed Insolvency Trustees of the obligation to take steps to ensure the continued delivery of Bankruptcy and Insolvency Act notices and documents in the event of a Canada Post service interruption. Subsection 6(1) of the Bankruptcy and Insolvency General Rules provides flexibility in the form of notice and document delivery asfollows:

Unless otherwise provided in the Act or these Rules, every notice or other document given or sent pursuant to the Act or these Rules must be served, delivered personally, or sent by mail, courier, facsimile or electronic transmission.

For the purposes of clarity, the Office of the Superintendent of Bankruptcy (OSB) considers email to be an electronic transmission.
