What is a Criminal Code decision?

In the course of an investigation into a trustee’s professional conduct, if the investigator has concerns, based upon reasonable grounds, that the trustee may have committed an offence as set out in the Bankruptcy and Insolvency Act or in the Criminal Code, the matter may also be referred to the Royal Canadian Mounted Police for investigation. Charges leading to judgment and sentencing may be filed against the trustee.

and whereas the Court is satisfied that the offender's serving his sentence in the community will not endanger the safety of the community.

now therefore, the Court orders that the offender serve the sentence in the community for the purpose of supervising the offender's behaviour, subject to the offender's complying with the conditions set out in the law and prescribed by the Court.

the offender shall, for a period of 2 years-1 day,

  • Keep the peace and be of good behaviour;
  • Appear before the Court when required to do so;
  • Report to the supervisor;
  • Remain within the jurisdiction of the Court unless written permission to go outside that jurisdiction is obtained from the Court or the supervisor;
  • Notify the Court or the supervisor of any changes of address or name and notify them rapidly of any changes in employment or occupation.

and in addition, the offender shall comply with the following conditions:

    2. shall be present at his domicile

      b/- between 23hoo and 7hoo am 7 days over 7 am for the next 8 months
      except:
      a/b/- for a legitimate and remunerated work
      a/b/- for medical purposes for him/himself and immediate family,
      a/- to practice a religious cult and notify your supervisor of the dates
      a/- for his visits to his surveillance officer, for visiting purposes of your daughters
      - orders the accused to have a telephone line available at all times and
      prohibits any call forwarding device
      - leave free access to his surveillance officer (or his representative) to his domicile at all time.
